Commencing from the initial financial year after June 1, 2023, companies are obligated to adhere to Corporate Tax regulations. Hence, it is imperative for companies to register with the Federal Tax Authority (FTA) and acquire a Tax Registration Number exclusively for Corporate Tax compliance.
When to register for Corporate Tax in UAE
The FTA extends its invitation to Public Joint Stock Companies and Private Companies for Corporate Tax purposes. It's noteworthy that Corporate Tax Registration will be made available to Free Zone Persons at a subsequent stage, ensuring comprehensive compliance.
Moreover, the Corporate Tax registration process will be extended to encompass other categories of Taxable Persons, including natural persons engaged in Business or Business Activity. The details for these categories will be outlined by a Cabinet Decision, and registration for these individuals will be initiated at a later date.
Who is required to register for Corporate Tax?
Every company in the UAE must register for corporate tax through the Federal Tax Authority (FTA). All taxable individuals must comply with UAE Corporate Tax regulations, obtaining a Corporate Tax Registration Number as outlined in the UAE Corporate Tax law and associated implementing decisions. This requirement applies even to companies not previously registered for VAT.
Kindly be aware that UAE branches of domestic companies are treated as integral parts of their parent or head office, not distinct legal entities for corporate tax registration. Consequently, UAE branches of a domestic juridical person are exempt from separate registration.
Register for UAE Corporate Tax on the Emaratax Platform
To initiate UAE Corporate Tax registration on the EmaraTax platform, follow these steps: Sign in or create an EmaraTax account, then navigate to the Corporate Tax tab in the Taxable Person dashboard. Complete necessary details, including Entity Type, trade license information, business activities, owner particulars, branch details (if applicable), registered address, and Authorized Signatory information. Verify the provided information, confirm its accuracy, and submit the application.
Currently, the Corporate Tax registration process is applicable solely to individual legal entities. If entities intend to establish a Corporate Tax Group, they must first register individually. Subsequently, they will be eligible to submit an application for the creation of a Corporate Tax Group at a later stage.
